I too have this same exact problem and Nissan will no pony up. I have a 06' Pathfinder and the fuel gage will not read properly.
Sometimes stuck between half and quarter and other times just drops all the way down to empty and the Service Engine Soon(check engine) light is on. They say it is out of the extended warranty period and that it was not a recall. Nissan Consumer affairs advised me to go a head and pay the $120 diagnostic fee and that couldn't assist me until that was done. I went ahead and bit the bullet knowing well what the issue was.
Got the diagnostics done and sure enough P0463 (faulty fuel sensor). Contacted Nissan consumer affairs again and gave them my case number and of course they tell me, sorry there's nothing we can do. I'm furious. Why in the world didn't they just tell me this from the beginning.
Very shady business practice if you ask me.
Did some more research and I found out that I'm not the only one. There are tons of others who have been bamboozled by these thief's that we call Nissan.
